Protecting Your Rights Through the Arrest Process
When you are pulled over on suspicion of driving drunk, the officer will likely conduct field sobriety tests including a Breathalyzer test.
If your blood alcohol level is greater than .08, you will be arrested, charged with DUI/DWAI and given a summons which will contain a date to appear in court for a first return. You must request a hearing with the Colorado Department of Revenue within seven days of receiving a notice of driver's license revocation to attempt to preserve your driving privileges. The nine-month revocation goes into effect on the eighth day, even if there is a timely request for a hearing, if a temporary permit is not issued. After 30 days it may be possible for individuals, except for minors, to have their driving privileges reinstated with an eight-month interlock restricted license.
