Recent Changes to Repeat DUI Laws
Governor Ritter signed legislation in May of 2010 that requires jail sentences for people who are repeat offenders. The new law imposes a minimum 10-day sentence for a second offense and 60 days for third and subsequent offenses, among other penalties. The law permits work-release but not electronic home monitoring if a second offense occurs within five years of the first offense. Repeat offenders are now required to be placed on probation for a period of two years and enter alcohol education and treatment programs.
Second and repeat offenders also risk losing their driving privileges for a considerable period of time. A second administrative license revocation by the Department of Motor Vehicles will result in a one-year suspension of your driver's license with no early reinstatement. A third or subsequent revocation will last two years with reinstatement or early reinstatement, including a two-year interlock requirement.
