Drunk Boating Is a Serious Crime in Colorado
It is a misdemeanor to operate or to be in control of a vessel in Colorado while under the influence of alcohol, with convictions carrying harsh mandatory penalties:
- First conviction: A fine of up to $1,000 and a jail sentence of not less than five days nor more than one year, and up to 96 hours of useful public service
- Subsequent conviction within five years: Fine of up to $1,500 and not less than 60 days nor more than a one-year jail term, and up to 120 hours of useful public service
Even if you were under the influence of a drug that you have a prescription for, that will not be a valid defense against BUI charges.
